These Terms govern the purchase of the Inertia X1 instrument, the use of this website, and the associated software. Users are kindly requested to read this document carefully before proceeding with a purchase. This Website is a service provided by:

1. Subject of Service and Intellectual Property

  • Nature of the Service:PAGAL Lab offers the mechanical tool Inertia X1 and its associated supporting software intended exclusively for the calculation and estimation of the swingweight of tennis rackets.
  • 3. Intellectual Property and TrademarkThe source code, calculation algorithm, graphic interface, and texts within this application and website are the exclusive property ofPAGAL LAB di Paolo Gallo. Any reproduction, modification, reverse engineering, or distribution of the software without written authorization is strictly prohibited.
  • Trademark:“PAGAL Lab” is a registered trademark. Unauthorized use of the name or logo is prohibited.

2. Terms and Conditions of Sale

  • Purchase Procedure:The contract is considered concluded at the moment the User makes the payment via the Stripe platform. Sending the order entails the obligation to pay the price, taxes, and any indicated shipping costs.
  • Prices and Descriptions:Prices and availability of Products are subject to change without notice. While the product is presented with the highest possible accuracy, images are intended for reference purposes only.
  • Availability and Batches:If a product is marked as "Pre-order" or as part of a new production batch, shipping will occur within the timeframe specified during the checkout process (typically 15 business days).

3. Delivery of Goods and Retention of Title

  • Shipping:Deliveries are made to the address provided by the User. PAGAL Lab is not responsible for delivery errors resulting from inaccuracies provided by the User or delays attributable to the carrier.
  • Check upon receipt:Upon delivery, the User is required to check the integrity of the package. In case of visible damage, it is recommended to accept the delivery "subject to inspection" (riserva di controllo) or to refuse the delivery.
  • Retention of Title:The User acquires ownership of the Product only upon full payment of the purchase price.

4. Right of Withdrawal (European Consumers)

  • Right to Cancel:European Consumers have the right to withdraw from the contract within14 daysof receiving the instrument without providing any justification.
  • Return Conditions:The instrument must be returned intact, in its original packaging, and showing no signs of wear. As this is a precision instrument, any decrease in value resulting from handling beyond what is necessary to establish its functioning will be deducted from the refund.
  • Costs:Shipping costs for returning the product are the sole responsibility of the User.

5. Physical Product Warranty and Manufacturing

  • Craftsmanship:The instrument is manufactured using additive manufacturing technologies (3D Printing). Minor aesthetic imperfections are intrinsic characteristics of the production process and do not constitute a lack of conformity.
  • Legal Warranty:The legal warranty of conformity applies according to EU regulations (24 months for private consumers, 12 months for professionals/VAT holders).
  • Heat Warning:Polymer components may undergo deformation if exposed to temperatures exceeding50°C(e.g., inside vehicles in the sun or proximity to heat sources). Such damage is considered improper use and is not covered by the warranty.

6. Limitation of Liability (Disclaimer)

  • Accuracy:Measurements provided are estimates based on the interaction between the hardware and user input. PAGAL Lab does not guarantee absolute metrological accuracy, which may be influenced by incorrect calibration, environmental vibrations, or component wear.
  • Third-Party Damage:PAGAL Lab is not responsible for any direct or indirect damage (e.g. broken rackets, frames, strings or smartphones) arising from the improper use of the device. As it is an oscillating device, it must be used on flat and stable surfaces.
  • Medical Disclaimer:Data provided must not be used for medical purposes (e.g., prevention of epicondylitis). PAGAL Lab assumes no responsibility for conclusions drawn by the user regarding their health based on swingweight data.
  • Legal Value:Provided data has no legal or official certification value.

7. Privacy and Data Processing (GDPR)

  • App DataAll measurement-related data is saved exclusively in the local memory of the user's device (LocalStorage). No technical data is transmitted to external PAGAL Lab servers.
  • Sales Data:Personal data provided during purchase (name, address, phone) will be processed exclusively for contractual, fiscal, and shipping purposes via Stripe (payment) and the designated carrier.

8. Governing Law and Jurisdiction

These conditions are governed by Italian law. For any dispute relating to the purchase or use of the instrument or software, the exclusive jurisdiction shall be theCourt of Naples..
